We do not warrant that the appearance of any product as displayed on your screen will exactly match the item you receive.

Because our products are hand-painted and handcrafted, minor variations in color, pattern, brushwork, and finish may occur. These variations are part of the character of handmade ceramics and are not considered defects.

All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Tavola Piena reserves the right to accept or decline any order at its discretion. Your order is not accepted until Tavola Piena confirms acceptance. Payment must be received and processed before an order is accepted.

Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order has been accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at checkout.

Your purchases are subject to return or refund solely in accordance with our Return and Refund Policy.

You represent and warrant that your purchases are for personal or household use only and not for commercial resale or export.

SECTION 5 - SHIPPING AND DELIVERY

We are not liable for shipping or delivery delays. All delivery dates and transit times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, service interruptions, customs processing, or events outside our control.

We carefully package our products due to their fragile nature. However, title and risk of loss pass to you once the order is transferred to the carrier.

Tavola Piena is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Tavola Piena. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Tavola Piena, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Tavola Piena.

Because our products are handcrafted ceramics, variations in appearance and minor imperfections are inherent to the product and are not considered defects.

Some jurisdictions do not allow the exclusion of certain warranties, so portions of this section may not apply to you.

To the fullest extent permitted by law, in no case shall Tavola Piena, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any injury, loss, claim, or damages of any kind.

This includes, without limitation, any direct, indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Services or any products purchased through the Services.

This limitation also applies to any damages resulting from errors or omissions in content, product availability, shipping delays, or damage occurring after the product has been transferred to the carrier.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so portions of this section may not apply to you.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tavola Piena, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or related to:

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

You and Tavola Piena agree to submit to the exclusive jurisdiction of the state and federal courts located in Illinois.
